Caffeinated Water Illegally Promoted According to FDA

On April 24, 2012, the U.S. FDA sent a Warning Letter to Vitality Distributing, Inc. indicating that the company's product "avitae caffeinated water" is being illegally promoted as an unapproved new drug due to claims relating to its safety and efficacy, such as the following:

"Did you know that caffeine could cut down a terrible disease called Alzheimer's by over 50%? It can also do all sorts of other great things like reduce heart disease in women by over 24%."

The FDA based its findings on review of the company's website (www.myavitae.com), postings on Facebook and Twitter, and materials distributed at the 2012 Natural Products Expo West trade show.
