Federal Court Bars Fusion Health From Promoting Vitamin D for COVID-19
On January 8, 2021, the United States Department of Justice announced a permanent injunction has been entered, barring dietary supplement marketer Matthew Ryncarz and his companies Fusion Health and Vitality LLC dba Pharm Origins and Fusion Ionz LLC dba Pharm Origins from making claims that their products can treat COVID-19.
According to the complaint, the companies sold and distributed vitamin D products which claimed to cure, mitigate, or treat COVID-19 and other illnesses. The FDA warned Ryncarz to stop selling the products Immune Shot, Immune Boost, and Core with unverified claims in May of 2020, and the state of Georgia began legal action in August.
The complaint charged that the defendant violated federal law by introducing unapproved new drugs into interstate commerce, and the claims that the products can treat diseases like COVID-19 are not backed up by scientific evidence.
The complaint was filed in U.S. Attorney's Office for the Southern District of Georgia at the request of the FDA.
In the U.S. Department of Justice news release, Deputy Assistant Attorney General Daniel J. Feith said, "The Department of Justice will not allow individuals to take advantage of consumers during a public health emergency by making unproven claims about unapproved drugs to profit from public panic. We will continue to work closely with the Food and Drug Administration to halt such conduct."
